Utilizing and selecting a Real Estate Agent

One of the most overlooked areas in investment may well be the role the real estate agent can play in helping the investor scope out property for a potential upside purchase. I just want to share a few thoughts that I have on this issue.

First ‘what can a real estate agent do for me’? I know many investors ask this perennial question. A good agent has a group of tools at their disposal such as MLS access. Those of us in the Tampa Association of Realtors have Mid Florida MLS which is a wide and expansive MLS that goes up to Orlando. This is a great way to see what is active and sold in the region in addition to Tampa Bay. Agents many times know certain subdivisions/areas quite well and can be a source of good history in an area as well as their thoughts on where prices are going in that particular area. They have access to thousands of agents through the MLS system as well. This allows for maximum exposure for both sales and purchases of real estate. The agent can also be your ‘eyes and ears’ as they are out in the field talking to owners, agents and working on MLS. The agent can be a valuable part of the investment process.

Second ‘selecting the agent’. This may well prove to be difficult. Many agents know the market, but finding an agent who knows the market well in the area of REO (Real Estate Owned), foreclosure and repair work can pose a challenge to the investor. In other words an agent who can look at a house and visually estimate a rough repair cost and factor that in to the asking price to determine a profit margin is hard to find. But that said they are out there. One just has to look around. Such a person when going through MLS on searches may well come across a property that has such upside potential and may well sell for less than list. While driving around this agent may see a house listed that looks like it has great potential but needs some exterior repairs. These people can be your ‘eyes and ears’ to locate prospects.

The first place to find such agents is from fellow investors who have had some good dealings with real estate agents. Finding also agents who list REO property on a regular basis is another way to find such an agent. Once found I suggest you take an agent out with you to look at a property or two, tell them what you look for, ask them what they look for in the property and spell out the criteria you seek in investment property such as sq ft, areas, bed/bath count/age etc. The real estate agent can be a big help to the investor in their search for property.

Elements of a Subject Too Closing

Basically you are purchasing the property by giving the current owner a cash payment and taking over their current mortgage (usually with out the lender knowing in advance). It is suggested that you obtain a Power of Attorney (we can provide you with a blank copy) specific to the property this will allow you the rights to deal with the lender and sell the property at a later date. At Alday-Donalson Title we will provide but are not limited to the following services for a subject too closing:

  • An O&E report will tell you if and how many liens and or judgments are attached to the property. We provide a 48 (business hours) turn around for this report. For TBREIA members the cost is $75.00. Should liens and or judgments exist we will help you get them cleared up.
  • Title insurance is optional at this point but highly recommended. You will need to provide title insurance at the time of sale. You may be able to get the buyer to pay for this if you negotiate it into the contract.
  • We offer the use of our facilities this includes copy, fax and computer services. If you need a mortgage, we have pre-typed formats available. We will notarize your documents in a clean professional office and offer you and your clients refreshments all for a fee of $100.00. Keep in mind you may be there for 20 minutes or in some cases as long as 2 hours!
  • You may elect to ask for other services that I have not mentioned. Rest assured we offer many options just ask!

THE 2006 FLORIDA BILL REGARDING FORECLOSURE SALES

An Act relating to residential foreclosure [SALES] procedures.

The House and Senate bills are very similar. For this reason I’ll refer to them as “the bill”.

Please also note that this discussion is NOT TO BE CONSIDERED LEGAL ADVICE. It is only the opinion of the author. Readers should seek appropriate legal counsel in deciding how the bill affects them.

The new bill this year is materially slimmed down from those introduced last year. GONE are the provisions prohibiting contact with people in foreclosure. GONE are the provisions requiring notices on orange paper. GONE are most requirements regulating sale of property in default. GONE are the extra disclosure requirements at most closings.

What’s left? The new bill focuses strictly on procedures and practices relating to surplus funds, left over when a property is sold at the steps for more than the accumulated liens.

That’s this year’s bill.

Funds left over after the sale, will be presumed to belong to the home owner who owned the home at the time of the Lis Pendens, rather than the home owner at the time of the sale. The right to the funds, can be assigned, but the transfer must be executed with the formality of a deed (presumably this means notarization and two witnesses), include a financial disclosure, include a statement that the owner does not need an attorney, and specify all forms of consideration paid for the rights to the funds. Even if the foregoing qualifications aren’t met, the transfer may still be ok if the court finds that the instrument documenting the transaction was executed in good faith and with no intent to defraud the transferee or assignee. There are civil fines for anyone who “willfully uses, or has willfully used, a method, act, or practice in violation of this part …”.

For most of us, the new bill is pretty much a non-event.
