TBREIA has 3 great sub-groups, which started in 2006 and are very successful. Thanks to the wonderful host & hostess’, who are holding those meetings. Jim Kirst, who started first with the Brandon sub-group for East Hillsborough, then Brenda Ayala for Tampa and Barbie Burgess, who is hosting the Mid-Pinellas sub-group. Things your Mortgage broker didn't tell you

First let me say that most mortgage brokers work really hard for their money. When you find a good one, pay them well. Total compensation to the broker of three (3) percent is something I feel is reasonable, maybe a little less if they’re a good friend, doing you a favor. Let them make a living.

HOW you pay them is the subject of this article.

Brokers make money in three areas; loan origination fees; junk fees and yield spread premiums. Junk fees and loan origination fees come out of the proceeds of the loan. Yield spread premiums are paid directly by the lender to the mortgage brokerage company and don’t come directly out of the proceeds of the loan.

When you look at your U.S. Department of Housing and Development settlement statement (frequently referred to as a HUD-1), you will see lines numbered between 800 and 900 on page 2. These are the fees charged by the lender and mortgage broker. Each line should say to whom the fees are being paid. We won’t deal with fees being charged by the lender (as opposed to the mortgage broker) since the mortgage broker doesn’t have control over the lender’s fees. Since some lenders also have “origination” fees, you have to look at the “to” section in the middle of each of the “800” lines and add up anything that shows up in the two right hand columns where the “to” entity is your mortgage broker’s company. Typically the loan fees show up in the Borrower’s column, but sometimes the Seller agrees to pay the fees and they show up in the Seller’s column. Yield spread premiums show as a line title, and frequently say “POC” meaning paid outside of closing, but aren’t deducted from the proceeds.

Mortgage broker origination fees are typically calculated as a percentage of the loan amount. Mortgage broker junk fees are (in my opinion) any fee other than loan origination fees, which are deducted from the proceeds of the loan and paid to the mortgage broker.

Yield spread premiums are paid by the lender to the mortgage broker directly and act as an inducement to the mortgage broker to jack up the interest rate. These premiums vary considerably from lender to lender. For instance, if an “A” quality borrower qualifies for a 6% loan (known as “PAR” pricing), lenders will frequently pay the mortgage broker something like one percent of the loan balance if the mortgage broker sells a 6.25% rate, two percent of the loan balance if the mortgage broker sells a 6.5% rate, and three percent if the mortgage broker sells a 6.75% rate. Lesser quality borrowers generally are charged an extra half percent rate for each percentage point of yield spread paid to the mortgage broker. For instance 6.5% gets the mortgage broker one percent premium, 7% pays two and 7.5% pays the broker three percent.

NOW, assuming that you have a total amount in mind, that you feel is appropriate compensation to your mortgage broker (treat them as you would want to be treated (ie fairly)) the trade off between origination/junk fees and yield spread premium will depend on how long you intend on holding the house. If you are planning on selling the house in one or two years, you probably want to reduce the origination/junk fees (and remember we’re only talking about the origination/junk fees paid to the mortgage broker, not the junk fees charged by the lender and title company, over which the mortgage broker has no control) and let the mortgage broker make their money on the yield spread premium.

For instance, on a $150,000 loan, if you’re comfortable paying your mortgage broker 3% in total, that’s $4,500. If you’re planning on holding the house for 5 to 10 years, pay the mortgage broker points and junk fees totaling $4,500, and make sure you get “PAR” pricing. If you’re planning on holding the house for only a year, have the mortgage broker charge you NO origination fee, and as few junk fees as his company will allow, and let the rate rise so that the mortgage broker can make his money on the yield spread premium.

NOTE, that if you’re planning on holding the house for less than 3 years, you need to also make sure that your mortgage broker gets you a loan with no prepayment penalty. Many lenders charge a fee or higher rate for eliminating the prepayment penalty, so run your numbers and compare the cost for eliminating the prepayment penalty to the cost of paying the prepayment penalty, so you know which is the better way to go.

Mark Wilson is a full time investor and has purchased 20 homes in the last 2 years, specializing in pre-foreclosures, subject to’s and short sales. Mark has served as CFO for a publicly traded REIT, held Series 7, 24, and 27 securities licenses and successfully placed over a dozen Reg D private placement real estate syndications.

Mark has his MBA in finance from the University of California at Berkeley, is an Ohio licensed CPA and attorney and a Florida licensed mortgage broker and real estate broker.
