Don't Miss These Write Offs!

As tax time approaches once again, This year you can thank your lucky stars that you have one of the greatest tax deductions of all time…your residence. Homeownership is the ultimate tax shelter. The Internal Revenue Service looks fondly on homeownership and provides a number of tax benefits for owners, but to take advantage of them you first must be familiar with allowable deductions.

The biggest deduction is the interest paid on home mortgage. For example, with a $1200/month mortgage payment of which 80% goes towards interest, you can deduct, depending on your tax bracket, up to $11,500 a year. Not bad considering you're also building equity in your home. Property taxes are also deductible, as well as certain loan origination fees or points.

Lesser Known Deductions

If you have to make improvements to your home because of a medical condition (prescribed in writing by your doctor), such as installing air conditioning, a swimming pool or handicap ramps, those expenses may be partially deductible. Don't forget moving costs. If you move more than 50 miles away, you can deduct the cost of moving yourself, household goods and vehicles to your new location. Even the land your home is on could be deductible. IRS Section 163 allows lease payments for land under a home to be deducted. The ground least must be for at least 15 years including renewal periods, be freely assignable, and contain a future option for you to buy the leased land. Certain expenses associated with building and working from a home office can also qualify you for a tax break, but guidelines are strict. You must sue the area designated as an office exclusively for business - dining room tables do not apply! Individuals who work at home are also entitled to deduct a portion of their home expenses, such as utilities, insurance a security system.

Agency Disclosure


In real estate the Law of Agency is the single biggest issue to be well versed in. For the investor this has a direct impact on you as well. I am going to give a brief overview of some principles, not a exhaustive treatment of the topic as time and space do not allow for this.

Basically when you encounter an agent about a property, he/she should first have you sign an Agency Disclosure or as known here in Florida ' the special notice'. Most agents invoke the 'Transaction Broker' box an as such represent the TRANSACTION. There are options also, and I just want to touch on one, and that is the 'Single Agent' representation or better known as the Buyers Agent in this case (there is also the Sellers Agent, for our purposes I am only touching on the Buyers Agent).

The buyers agent owes fiduciary duty to the BUYER. I suggest you look at this closely and if you do engage an agent ask them if they will be a Buyers Agent and represent you in the transaction. This may well give you better ability to present an offer below list price as your agent is your advocate in the transaction.

Many times we see listing agents asking that you call them on property. This can well be done. I myself would want someone I can confide in to act on my behalf only. It just depends on the desires of the one seeking to make an offer on a property.

Acting as a Transaction Broker is safer for the agent as it lessens the possibility of a law suit since the agent is representing the transaction.
